Data protection statement
Subject matter of this statement is the collection, processing and use (utilization) of personal data gathered when making use of the TKL range of products and services. We are delighted at your interest in our website. Below you will find information on how your data is handled.
General information
1. Responsible authority
The responsible authority in terms of the data protection law is TKL (see legal notice). Mr Dragan Stanković is the person in charge of all data privacy issues. If you have questions concerning the utilization of your personal data or you want to make use of the legal remedy described here, just fill out the contact form. Naturally, it is also possible to deploy the TKL range of products and services without providing personal information. In that event only access data without personal references is gathered (e.g. name of the internet provider, used browser type, the site where from you started looking for the product or the name of the requested file); this makes tracing you impossible. This data is used exclusively for the improvement of our products and services.
2. No consent through use
Decisive factor for the use of your data are the respectively applicable statutory regulations, particularly the Federal Data Protection Act and the German Telemedia Act. If and when data is gathered for a purpose requiring your consent according to these regulations, you will be asked for your explicit consent in each case. You can revoke the once given consent any time with future effect and/or object to the future usage of your data. The mere registration, use of services or acknowledgment of this declaration is not a substitution for your explicit declaration of consent.
3. Utilization of your personal data
Outlined below are the possible uses of your data.
1. Data collection
Personal data is collected when you initiate the participation in a seminar, request a catalogue or sign up for a newsletter; gathered for this are your personal details and the data required for processing. From this information only those details required for the contractual relationship are regarded and designed as compulsory statements. If you use recurring functions, TKL automatically gathers and saves technical information from your browser in the server logs. This particularly relates to data deposited with so-called cookies (cf. paragraph "Cookies") and required for service functions.
2. Data processing and use
TKL uses the gathered data for four primary purposes, although actually not all data is used for all purposes:
1. Your account data including personal information and your address (inventory data) is used to establish and handle the contractual relationship (seminars).
2. Date concerning your usage of individual products/services (usage data) is used for our technical processing of the usage service (e.g. catalogue request or newsletter). Here, it may happen that certain usage data of different services is merged for the purpose of coordination.
3. Upon completed execution of the contractual relationship (seminars) your data will be blocked for further use and deleted upon expiry of the fiscal and commercial law retention periods, unless you have explicitly consented to the further usage of your data (e.g. newsletter).
4. When signing up for the newsletter, your e-mail address will be used for internal advertising purposes until you unsubscribe again.
3. Data transfer to third parties
TKL only ever transmits your personal data to third parties if:
1. the transfer is required for the realization or billing of participation at a seminar, particularly, if a third party requires this data for handling the contractual relationship (such as credit card companies or seminar service providers; those parties are only provided with the information required for their service).
2. If and when in a given case we have a legitimate interest in transmitting your personal data to third parties within the limits of the law, who are authorized to carry out validity checks of the entered data (such as credit card information, banking details etc.) and for credit scoring. In doing so, the information is only transferred to parties required for processing. This might include the stated bank as well as the following companies, TKL is working with:
Logistics companies (e.g. letter post)
3. Moreover, according to applicable laws public authorities may request information or data to fulfil their lawful tasks, for instance for the prosecution purposes.
4. Deletion of data
Provided your data is no longer required for the aforementioned purposes including settlement, the information will be deleted. Please note that with each deletion the data is initially only blocked and will only be permanently deleted with delay to prevent accidental deletion or potential deliberate damages. For technical reasons data may be duplicated in backup files and service data mirroring. Such copies will also only be deleted after a delay due to technical reasons. Moreover, on the grounds of commercial and tax law we are obliged to store certain data regarding processed transactions for a specific period of time.
4. Cookies
Cookies are files stored on a computer's hard disk to simplify navigation. They render a renewed manual input of all required information for each individual time of use unnecessary. Cookies simplify the usage of the TKL range of products and services. You can prevent cookies from being stored on your hard disk by selecting "Accept no cookies" in your browser settings. You can also set your browser to request your consent before setting cookies. After all, it is also possible to delete set cookies any time. For details on how this can be done, please see the instructions of your browser manufacturer.
5. Right of access
Naturally, you are entitled to request access to your stored personal data from TKL at any time free of charge. Provided you are registered, the data can be found in your user account and there can be corrected, blocked or deleted any time. Please note that the data stored offline will only be deleted when they are no longer required to handle the contractual relationship. If you are not registered, please send the request in a mail using the contact form. If you want us to permanently delete your user account, please send us an e-mail via the contact form (cf. paragraph "Deletion of data").
6. Newsletter and advertising / revoking a declaration of consent
Should you have given your consent for the newsletter subscription or to receive advertising material within the scope of the TKL range of products and services, you can revoke this consent any time with future effect. Please use our contact form to revoke your consent.
7. Data security
TKL constantly endeavours to protect your data against unauthorized access, loss, misuse or destruction. Your personal data is only accessible to those employees, who necessarily have to see your data in order to carry out their work properly and to be able to offer you services and products in the best possible way. Sensitive data is transmitted to TKL using SSL encryption. Registered customers can only access their customer account after entering user name and password; you should therefore always treat your access information confidentially and not make it available to third parties. Before opening another website we also recommend closing your browser window completely after each usage of the TKL range of products and services requiring login; particularly if you use the computer with another person, other people can access your computer or you are using a public internet connection.

9. Use of plugins
The TKL website also uses so-called plugins. If you call up TKL websites featuring such plugins, a connection to the servers of the respective plugin provider is established and the plugin is displayed on the website via a message to your browser. Through this, information regarding which websites you have visited is passed on to the plugin provider's server. If you are registered with the plugin provider, it is possible to assign this information to your personal user account. When using plugin functions (e.g. clicking a button, leaving a comment), this information too might be assigned to your user account, which can however be prevented by logging off prior to using the plugin.

10. For individual offers TKL uses the coupon system of the Sovendus GmbH
For the purpose of selecting a coupon offer that is currently relevant for you TKL pseudonymizes the hash value of your e-mail address and transmits it along with your IP address in encrypted form to Sovendus: Sovendus GmbH, Moltkestr. 11, 76133 Karlsruhe (art. 6 para. 1 lit. f of the GDPR). The pseudonymized hash value of the e-mail address is used to consider a possibly existing objection to receive advertising material from Sovendus (art. 21 para. 3, art. 6 para. 1 lit. c of the GDPR). Sovendus will only use the IP address for data security purposes; as a rule it will be anonymized after seven days (art. 6 para. 1 lit. f of the GDPR). Furthermore, we will transmit the order number, order value with currency, session ID, coupon code and time stamp to Sovendus in pseudonymized form for billing purposes as well (art. 6 para. 1 lit. f of the GDPR). If you are interested in one of the Sovendus coupon offers and there is no existing objection to receive their advertising material, you can click on the coupon banner (only displayed if the stated conditions are met); then TKL will transmit your title, name and e-mail address to Sovendus in encrypted form in order for them to prepare the coupon (art. 6 para. 1 lit. b, f of the GDPR).

11. For individual offers TKL uses the special offers of the Sovendus GmbH
For the purpose of selecting a regional special offer that is relevant for you TKL pseudonymizes and encrypts certain information (such as your title, year of birth, country, post/zip code, the hash value of your e-mail address and your IP address) and transmits it to Sovendus: Sovendus GmbH, Moltkestr. 11, 76133 Karlsruhe (art. 6 para. 1 lit. f of the GDPR). The pseudonymized hash value of the e-mail address is also used to consider a possibly existing objection to receive advertising material from Sovendus (art. 21 para. 3, art. 6 para. 1 lit. c of the GDPR). Sovendus will only use the IP address for data security purposes; as a rule it will be anonymized after seven days (art. 6 para. 1 lit. f of the GDPR).
When you click on a special offer, we will further transmit your name, address data and e-mail address to Sovendus in encrypted form in for them to prepare the personalized request for the special offer for the respective product provider (art. 6 para. 1 lit. b, f of the GDPR).
